Mississippi 340B law upheld by appeals court in two cases
The U.S. Court of Appeals for the 5th Circuit April 9 affirmed rulings by a Mississippi district court that rejected requests by Novartis and PhRMA to enjoin enforcement of the state’s law protecting 340B pricing for contract pharmacy arrangements. The 5th Circuit rejected a similar challenge by AbbVie in September 2025. The AHA filed an amicus brief in defense of Mississippi’s 340B contract pharmacy law in June 2024.
