When liability is problematic in a medical malpractice case, traditional defense strategies may not be enough. This webinar introduces health care risk professionals to innovative, practical approaches for mitigating damages by leveraging third-party benefits, real-life care needs, and early intervention. Participants will learn how to conduct objective benefits analyses, identify essential data for long-term care planning, and apply these insights during mediation to support fair and timely resolutions. Real-world case applications and mediation strategies will be explored to help attendees confidently manage complex claims and reduce financial exposure for their institutions.

Learning Objectives:

  1. Identify three key strategies to manage a critical medical malpractice incident in which liability is problematic and discuss how to use those strategies meet the patient’s (claimant’s) care needs at time of discharge as well as promoting a timely, fair, resolution for the hospital and/or health care providers.
  2. Define key data essential to an objective benefits analysis that will provide for the actual long-term quality of life needs of the patient (claimant).  
  3. Identify current and future benefits and other resources that can provide a basis for negotiating problematic liability cases.
  4. Explain how the care analysis and benefits information can be utilized during the mediation process – educating the mediator and defense counsel during the negotiation.  
  5. Demonstrate understanding of how to use these strategies to resolve problematic cases by applying them to appropriate medical malpractice claims in their institution.

Speaker:

Brenda Lillington is the Executive Director for the Professional Medical Hospital Liability ("PMHL") Program for University of California at Office of the President ("UCOP"), Risk Services. The PMHL Program is part of Risk Services' Self-Insurance Program for the University of California which oversees claims, manages the third party administrator, and assists in risk reduction efforts. Brenda comes to UCOP from UCSF Medical Center Risk Management, where she assisted in daily monitoring and management of claims, analyzing risks and implementing and monitoring risk reduction measures.

Ann Koerner, RN, BSN, CRRN, is the founder and CEO of National Care Advisors. Her company provides professional case management and education consulting services throughout all 50 states as well as litigation support services. Ann's career as an RN, Certified Rehabilitation RN includes extensive experience serving as an expert on the cost of future care and value of third party benefits. She has assisted with the successful resolution of medical malpractice, liability and workers compensation claims on a national basis.
