Understanding which legal protections apply to different types of risk, safety, and quality work product is essential for healthcare risk professionals. This session will provide a practical comparison of patient safety work product protections, attorney-client privilege, attorney work product protections, and state peer review protections, highlighting the unique purpose, strengths, and limitations of each. Participants will learn how to identify the nature of various work products generated within their organizations and develop appropriate pathways for maximizing available legal protections. Attendees will also receive a crosswalk tool that can be used to evaluate and strengthen their organization's approach to protecting sensitive safety and quality information.
